■ AI로 얼굴과 목소리까지 바꾼다
금감원이 밝힌 수법은 이렇습니다. 불법업자들은 유튜브 등 SNS에서 유명 증권사 직원 등을 사칭하며 주식 투자에 관심 있는 사람에게 도움을 주겠다고 접근합니다.
이때 AI 딥페이크 기술로 실제 존재하는 전문가인 척하고, 원금 보장과 고수익을 약속하며 가짜 투자 수익률을 보여 줍니다. 금감원은 눈속임을 위해 AI로 얼굴과 목소리까지 그럴듯하게 변장한다고 설명했습니다.
■ 링크, 단체방, 가짜 앱
다음 단계는 단체 채팅방입니다. SNS에 올린 링크로 투자자를 단체방에 끌어들이고, 가짜 주식거래 앱 설치를 종용합니다. 금감원은 이 앱이 증권사 앱과 구분이 어려울 정도로 정교하다고 적었습니다.
단체방에서는 바람잡이로 추정되는 사람들이 성공 사례를 보여 주고, 더 특별한 정보를 주겠다며 1:1 대화방으로 다시 끌어들이기도 합니다. 처음에는 수익이 난 것처럼 꾸며 입금을 유도하고, 나중에 돈을 돌려 달라고 하면 변명을 늘어놓다 연락을 끊습니다.
■ 'AI 자동매매'를 판다면
AI로 알아서 매매해 준다는 프로그램은 어떻게 봐야 할까요?
금감원의 2025년 6월 유사투자자문업자 점검 결과 자료는 주요 불법행위 유형으로 '미등록 투자일임업'을 들었습니다. 고객 계좌에서 자동으로 매매가 이루어지도록 하는 자동매매 프로그램 판매가 여기에 들어가고, 예로 카피 트레이딩과 AI주식자동매매를 적었습니다. 누구든 금융투자업 등록 없이 투자일임업을 할 수 없다는 자본시장법 제17조가 근거입니다.
같은 자료에 따르면 금감원은 2024년 745개 유사투자자문업자를 점검해 112개사에서 130건의 위법 혐의를 적발했습니다.
■ 유사투자자문업자는 금융회사가 아니다
유료 리딩방이나 주식 정보 서비스의 상당수는 유사투자자문업자입니다. 금감원은 이들이 제도권 금융회사가 아니라 신고만으로 누구나 영업할 수 있고, 전문성과 거래 안정성이 검증되지 않았으며, 금감원 분쟁조정 대상도 아니라고 설명합니다.
하면 안 되는 일도 정해져 있습니다. 1:1 투자자문, 손실 보전이나 이익 보장, 근거 없이 높은 수익률을 내세우는 광고, 금융회사로 착각하게 하는 표시·광고입니다. 2024년 8월부터는 유료회원 대상 양방향 SNS 채널 영업도 금지됐습니다.
■ 돈을 내기 전에 확인할 것
첫째, 업체를 조회합니다. 금융소비자 정보포털 파인(fine.fss.or.kr)에서 제도권 금융회사인지, 신고된 유사투자자문업자인지 확인할 수 있습니다.
둘째, 증권사 직원이라며 투자를 권하면 그 회사 고객센터에 재직 여부를 확인합니다. 명함의 전화번호는 가짜일 수 있으니 회사 대표번호를 직접 검색해 연락하라고 금감원은 권합니다.
셋째, 계약서의 환불 조건을 봅니다. 이용료를 내기 전에 환불 조건과 방법을 꼼꼼히 따져 실제로 환불이 되는지 확인하라는 것이 금감원의 당부입니다.

즉시 거래를 멈추고 녹취나 문자메시지 같은 증빙자료를 확보합니다. 신고는 금감원 홈페이지 → 민원·신고 → 불법금융신고센터에서 하고, 경찰청(112)이나 금감원(1332)에 알릴 수도 있습니다. 계약 해지나 환불 지연 같은 계약 피해는 한국소비자원에 피해구제를 신청할 수 있습니다.

FSS material lists selling 'AI stock auto-trading' programs as an example of discretionary investment business that may not be run without registration. Before paying anyone, check on the FSS's FINE portal that the firm is registered or reported.
On Naver's Q&A service, a search for 'AI investing' returns more than 48,000 questions as of September 24, 'AI stock analysis' 7,639 and 'ChatGPT stocks' 1,262.
■ Faces and voices faked with AI
The FSS describes the scheme: operators impersonate staff of well-known brokerages on social media such as YouTube and approach people interested in stocks, offering help.
They use AI deepfakes to pose as real experts, promise guaranteed principal and high returns, and show fake returns. The FSS says they even disguise faces and voices convincingly with AI.
■ Links, group chats, fake apps
Next comes the group chat: links posted on social media draw investors into group rooms, where they are pushed to install a fake trading app - one so elaborate it is hard to tell from a brokerage's, the FSS says.
In the rooms, people presumed to be shills show success stories, and some lure victims to private 1:1 chats for 'special' tips. Early 'profits' are staged to prompt deposits; when victims ask for their money back, the operators make excuses and cut contact.
■ If someone sells 'AI auto-trading'
What about programs that promise to trade for you with AI?
The FSS's June 2025 report on its inspection of 'quasi-investment advisers' lists unregistered discretionary investment business as a major illegal practice. It includes selling auto-trading programs that trade automatically in a customer's account, with copy trading and AI stock auto-trading as examples. The basis is Article 17 of the Capital Markets Act, which bars anyone from that business without registration.
According to the same report, the FSS inspected 745 quasi-investment advisers in 2024 and found 130 suspected violations at 112 firms.
■ Quasi-investment advisers are not financial institutions
Many paid stock-tip rooms and services are run by quasi-investment advisers. The FSS says they are not regulated financial institutions: anyone can operate after simply reporting, their expertise and stability are unverified, and disputes with them are outside FSS mediation.
Some things are off-limits: 1:1 investment advice, guaranteeing against losses or promising profits, advertising high returns without basis, and presenting themselves as a financial institution. Since August 2024, operating two-way social media channels for paying members has also been banned.
■ Check before you pay
First, look the firm up on the FSS's FINE consumer portal (fine.fss.or.kr) to see whether it is a regulated institution or a reported quasi-investment adviser.
Second, if someone claiming to work for a brokerage urges you to invest, check their employment with the company's customer center. The number on a business card may be fake, so search for the company's main number yourself, the FSS advises.
Third, read the refund terms. Before paying fees, check the refund conditions and method and whether refunds are actually possible.
■ If you suspect fraud
Stop trading at once and keep evidence such as recordings and text messages. Report through the FSS website's illegal finance reporting center, or to the police (112) or the FSS (1332). For contract problems such as cancellation or delayed refunds, you can apply for relief to the Korea Consumer Agency.
